CMS advised DRI on PPAs with OMV Petrom

CMS has provided legal counsel to DRI, the EU renewables division of Ukrainian private energy company DTEK, in relation to the physical power purchase agreements (PPAs) concluded with OMV Petrom for three solar projects. 

This marks the largest PPA transaction ever recorded in Romania, structured based on the EFET (European Federation of Energy Traders) template contract, which CMS had previously assisted in adapting to the Romanian legal and regulatory framework.

Under the terms of the agreement, electricity delivery is scheduled to begin in January 2026, with OMV Petrom set to acquire 62% of the electricity generated by DRI's Glodeni I and Glodeni II solar projects. For DRI's Vacaresti solar project, 

OMV Petrom will purchase 50% of the output starting in January 2027. The combined capacity of the three projects amounts to 239 MW. Over a period of 8.5 years, the PPAs are expected to facilitate the generation of approximately 100 GWh of electricity annually.
